2 This defendant and Gene Phillips were charged jointly in the Superior Court of Comanche County, Oklahoma, by information, with breaking and entering on September 24, 1961, in the night time and shortly after 12:00 a.m., a certain business building of one Henry Fink, located at 1717 Sheridan Road in Lawton, said county and state; said building being a place where personal property of the said Henry Fink was kept, with the intent to and "did stealthily, burglariously and feloniously take, steal and carry away * * * 1 transistor radio, 1 electric razor, 10 boxes of .22 shells, 2 Timex witches, 2 .22 pistols, and approximately $500 in good and lawful money of the United States", the personal property of the said Henry Fink.
